1. Agreement to Terms

By accessing or using Dehoist ("Service"), operated by Recodive oHG ("we," "us," or "Company"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Dehoist is a Discord bot and web dashboard (available at https://dehoist.com) that automatically removes so-called "hoisting" characters from Discord guild member display names and, optionally, performs further name cleanup (text cleanup, romanization of non-Latin scripts, and similar transformations) so that member lists render consistently.

The Service consists of:

A Discord application (the Dehoist bot) that operates inside Discord guilds to which it has been invited by a guild administrator.
A web dashboard at https://dehoist.com where guild administrators can configure the bot, review activity, and manage their subscription.

3. Eligibility

You must be at least 16 years old to use this Service. By using Dehoist, you represent and warrant that you are at least 16 years of age and have the legal capacity to enter into these Terms.

4. Account Registration

4.1 Accounts are provided by Orca

Dehoist does not operate its own sign-in system. Authentication for the Dehoist dashboard is performed through Orca, Recodive oHG's centralised identity platform at https://account.recodive.com.

By signing in to Dehoist, you acknowledge and agree that:

Account creation, email verification, password management, two-factor authentication, linked third-party providers (e.g. Discord), profile data, and account deletion are handled by Orca and are governed by the Orca / Recodive account terms and the Recodive Privacy Policy.
Dehoist receives only a short-lived authentication token and a limited subset of profile claims from Orca (user ID, email, display name, username, Discord user ID if linked, granted Discord scopes, and role). Dehoist does not store your password, two-factor secrets, or primary account credentials.
Changes to your account email, username, password, 2FA configuration, or linked providers must be made on Orca at https://account.recodive.com/account. Deleting your Recodive / Orca account will terminate your ability to sign in to Dehoist.

4.2 Account Security

Account security obligations apply at the Orca level and are inherited by your use of Dehoist. In particular, you are responsible for:

Maintaining the confidentiality of your Orca credentials.
All activities that occur under your account on Dehoist.
Notifying us immediately of unauthorised access via [email protected].

5. Premium Subscription

5.1 Merchant of Record

All paid Dehoist offerings are sold through Discord's Application Directory and processed by Discord Inc. as the merchant of record under Discord's Paid Services Terms. Recodive oHG does not store or process payment card data, billing addresses, or other financial information. We receive only an entitlement or SKU identifier together with the purchasing user's Discord ID from Discord.

5.2 Plans and Pricing

The following Dehoist offerings are currently available:

Dehoist Pro — recurring subscription at $1.99 / month. Provides access to all Pro features and extended activity logs.
Essentials Bundle — one-time $1.99 purchase; entitlement valid for 90 days.
Text Cleanup Bundle — one-time $2.99 purchase; entitlement valid for 90 days.
Romanization Bundle — one-time $2.99 purchase; entitlement valid for 90 days.

All purchases are made inside the Discord client via the Application Directory listing for Dehoist. Pricing shown in the Discord client at the time of purchase is authoritative and may be localised by Discord. We reserve the right to adjust pricing; subject to Section 5.4, changes will not affect an active billing period.

5.3 Automatic Renewal and Cancellation

Recurring subscriptions (Dehoist Pro) automatically renew through Discord at the end of each billing period unless cancelled.
Bundle purchases are one-time 90-day entitlements and do not renew.
You may cancel an active Dehoist Pro subscription at any time through the Discord client (User Settings → Subscriptions). Cancellation takes effect at the end of the then-current billing period.

5.4 Price Changes

We reserve the right to modify subscription prices. Where Discord notifies us of an upcoming price change, we will provide at least 30 days' advance notice to active subscribers via the Dehoist dashboard or by email. Price changes do not affect your current billing period. If you do not agree to the new pricing, your subscription will end at the conclusion of your current billing period.

6. Right of Withdrawal, Refunds, and Chargebacks

Because Discord Inc. is the merchant of record for every paid Dehoist offering, statutory EU withdrawal rights under Directive 2011/83/EU (the 14-day cooling-off period, the digital-content consent carve-outs, and related rights), as well as refund requests, chargebacks, and renewal cancellations, are handled exclusively through Discord's Paid Services Terms and Discord's refund flow. Complaints relating to the delivery or performance of the Service itself — for example, the bot failing to perform as advertised in a guild where an active entitlement exists — should nevertheless be directed to us at [email protected]. We will investigate such complaints and, where appropriate, coordinate with Discord on your behalf.

7. User Conduct

You agree not to:

Violate any applicable laws or regulations, including Discord's Terms of Service and Community Guidelines.
Infringe on intellectual property rights.
Transmit malicious code or viruses.
Attempt to gain unauthorised access to our systems.
Reverse engineer or decompile the Service.
Use the Service for commercial purposes not permitted by these Terms.
Harass, abuse, or harm other users, including Discord members whose display names are processed by the Service.
Misrepresent your identity or affiliation.

8. Intellectual Property

8.1 Our Property

The Service, including all content, features, and functionality, is owned by Recodive oHG and protected by international copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable licence to:

Invite and use the Dehoist bot in Discord guilds where you have the authority to do so.
Access the Dehoist dashboard for personal or guild-administration purposes.
Access Premium features while you hold a valid entitlement.

8.3 User and Guild Content

You retain ownership of content you create. To the extent required to operate the Service (for example, applying configured module settings to a guild you administer), you grant us a worldwide, royalty-free licence to use and display that content as part of the Service.

9. Privacy

Your use of the Service is subject to our Privacy Policy. By using the Service, you consent to our data practices as described there.

10. Service Quality and Liability

10.1 Service Standards

We strive to provide Dehoist in accordance with current technical standards and the service description. The Service will conform to the features and functionality described in our documentation. We will maintain and update the Service to ensure it remains functional and secure.

10.2 Third-Party Dependencies

Dehoist relies on third-party services, including:

Discord — the platform on which Dehoist operates, and the merchant of record for paid offerings.
Cloudflare — content delivery and DDoS protection for dehoist.com.
Sentry — error reporting and application monitoring.

We are not responsible for:

Changes to Discord's API, application directory policies, or service availability.
Outages or changes at our infrastructure providers beyond our reasonable control.
Content displayed through the Service that originates from third parties (including Discord member display names).

10.3 Statutory Warranty Rights

Your statutory warranty rights under German and EU law remain unaffected. For digital services, we provide updates necessary to maintain conformity for the duration of your subscription.

11. Limitation of Liability

11.1 Exclusion of Damages

To the maximum extent permitted by law, Recodive oHG shall not be liable for:

Indirect, incidental, special, or consequential damages.
Lost profits, data, or business opportunities.
Service interruptions or data loss.
Damages exceeding the amount paid by you for the Service in the last 12 months.

11.2 Essential Rights

The following limitations cannot be excluded under German and EU law:

Liability for intent and gross negligence.
Liability under product liability laws.
Fraudulent concealment of defects.
Any other mandatory statutory liability.

Note: These are standard legal protections that cannot be waived under consumer protection laws.

12. Indemnification

You agree to indemnify and hold harmless Recodive oHG, its partners, officers, and employees from any claims, damages, or expenses arising from:

Your use of the Service.
Your violation of these Terms.
Your violation of any third-party rights, including the rights of Discord members in guilds you administer.

13. Modifications

13.1 Terms Updates

We may make minor modifications to these Terms (including clarifications or legal compliance updates) at any time. Changes will be communicated via:

Posting revised Terms on our website.
Email notification to registered users.
In-product notification on the Dehoist dashboard.

Note: Minor changes become effective 30 days after notification.

13.2 Material Changes

For material changes that affect your rights or obligations (including price increases or changes to core service terms), we will:

Post the revised Terms on our website.
Notify registered users at least 30 days in advance via email.
Notify users in-product.

Important: Material changes do not affect your current subscription period. Your existing Terms remain in effect until the end of your current billing cycle. To renew your subscription after the current period ends, you must accept the updated Terms. If you do not accept them, your subscription will expire at the end of the current billing period and will not be renewed.

13.3 Service Changes

At any time, we reserve the right to:

Modify or discontinue features.
Introduce new features or services.
Update technical requirements.

14. Termination

14.1 By You

You may terminate your use of the Service at any time by:

Removing the Dehoist bot from your Discord guild(s).
Cancelling your subscription through Discord.
Requesting account deletion on Orca at https://account.recodive.com/account.

14.2 By Us

We may terminate or suspend your access to the Service immediately for:

Violation of these Terms.
Fraudulent or illegal activity.
Non-payment reported by Discord.
Extended inactivity.

14.3 Effect of Termination

Upon termination:

Your right to use the Service ceases immediately.
Guild configuration for guilds from which Dehoist has been removed is retained for 30 days and is then deleted, unless a legal retention obligation applies.
Where your Recodive / Orca account is deleted, any Dehoist-side personal data linked to that account is deleted within 30 days.
Provisions that should survive termination will remain in effect.

15. Governing Law and Jurisdiction

15.1 Applicable Law

These Terms are governed by the laws of Germany, without regard to conflict-of-law principles.

15.2 Jurisdiction

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Berlin, Germany.

15.3 Consumer Rights

If you are a consumer residing in the EU, you enjoy additional protections under mandatory consumer protection laws.

16. General Provisions

16.1 Entire Agreement

These Terms constitute the entire agreement between you and Recodive oHG regarding the Service, subject to the separate Discord Paid Services Terms that govern paid purchases.

16.2 Severability

If any provision is found unenforceable, the remaining provisions will continue in effect.

16.3 Waiver

Failure to enforce any right or provision does not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign these Terms without our prior written consent. We may assign our rights and obligations without restriction.
